The legal entity above is the controller of the personal data described in this policy.

Nigmatic is established in the Republic of Cyprus. Please direct all data protection questions to info@nigmatic.pro.

What this policy covers

This policy covers the Website (nigmatic.pro and its sub-pages) and every Application published by Nigmatic on the Apple App Store and Google Play. Where an Application processes data differently, its store listing or in-app notice will say so.

What we collect

  • Information you give us. If you create an account, we collect the details needed to run it, typically your email address and name. If you contact us, we keep the correspondence.
  • Information collected automatically. Technical information such as app version, device type, operating system, device or app identifiers, crash reports and usage statistics, to keep the Applications working and to understand which features are used.
  • Information collected when you visit the Website. Technical information such as your IP address, browser type and version, device and operating system, pages visited, referring page, and the date and time of your visit, collected through server logs and, where applicable, cookies and similar technologies (see Cookies and similar technologies below).

Applications that do not require an account, and the Website, collect only technical information unless you choose to contact us. We do not collect or store payment card details: purchases are handled by Apple and Google through their stores.

Providing account details is necessary to create and use an account; if you do not provide them, you can still use those features of the Applications that do not require an account. Technical information is needed to deliver the Applications to your device and to display the Website in your browser. You are not under any statutory obligation to provide personal data to us.

  • To provide the Applications, the Website and your account: performance of our contract with you (Art. 6(1)(b) GDPR).
  • To provide support and answer your requests: performance of contract or our legitimate interest in responding to you (Art. 6(1)(b) or (f) GDPR).
  • To keep the Applications and the Website secure and to detect and prevent technical issues, fraud and abuse: our legitimate interests in protecting our systems, our users and our business (Art. 6(1)(f) GDPR).
  • To analyse usage and improve the Applications and the Website: our legitimate interests in understanding how the Applications and the Website are used and improving them or, where the law requires it, your consent (Art. 6(1)(f) or (a) GDPR).
  • To operate, measure and settle our commercial and referral arrangements with partners: our legitimate interests in running and being paid for our business (Art. 6(1)(f) GDPR) or, where the law requires it, your consent (Art. 6(1)(a) GDPR).
  • To promote our Applications and, where the law requires it with your consent, third-party products and services: our legitimate interests in promoting our business (Art. 6(1)(f) GDPR) or your consent (Art. 6(1)(a) GDPR).
  • To manage corporate transactions and to establish, exercise or defend legal claims: our legitimate interests in managing and protecting our business (Art. 6(1)(f) GDPR).
  • To comply with legal obligations, such as tax and accounting rules: legal obligation (Art. 6(1)(c) GDPR).

Where consent is required for tracking, advertising, attribution or access to information stored on your device, the relevant technology will not be used until you have given consent. You may withdraw that consent at any time.

We do not make decisions based solely on automated processing, including profiling, that produce legal effects concerning you or similarly significantly affect you.

Sharing

We may share personal data with third parties for the purposes described in this policy, on the legal bases set out under “Why we use it and our legal basis”, and only to the extent necessary for those purposes. The categories of recipients are:

  • service providers acting on our behalf, such as hosting, cloud, analytics, crash-reporting, customer-support, communication and IT-security providers, under written contracts that require them to process the data only on our instructions;
  • public data services that our Applications contact for publicly available information, such as exchange rates, and which receive your device’s IP address;
  • business and commercial partners, including partners whose applications, products or services are featured in or linked from our Applications, and advertising, attribution and measurement partners, for example to confirm and settle referrals or to measure the performance of our Applications and links. These partners may use the data as independent controllers under their own privacy policies. Where the law requires your consent, for example for tracking or for accessing information on your device, we share data for these purposes only with your consent;
  • our affiliated companies, if any, for the purposes described in this policy;
  • app store operators, such as Apple and Google, where you use their stores, under their own privacy policies;
  • professional advisers, such as lawyers, accountants, auditors and insurers;
  • public authorities, regulators, courts and law enforcement, where required by law, or where necessary to establish, exercise or defend legal claims or to protect the rights, safety or security of Nigmatic, our users or others;
  • prospective or actual buyers, investors or successors, in connection with a merger, acquisition, financing, reorganisation or sale of all or part of our business or assets; and
  • any other third party, with your consent or at your direction.

Cookies and similar technologies

The Website and the Applications may use cookies, software development kits (SDKs) and similar technologies that store or read information on your device.

  • Strictly necessary technologies are used to deliver the Website or an Application that you have requested, for example to keep it secure, balance load or remember your cookie choices. They do not require your consent.
  • Other technologies, such as analytics, attribution and advertising technologies, are used only with your consent where the law requires it. You can give, refuse or withdraw consent at any time through the cookie or privacy settings on the Website, in the Application or in your browser or device settings. Withdrawing consent does not affect processing carried out before it.

Some cookies may be placed by third parties, such as analytics or advertising partners, who process the information under their own privacy policies.

Our Applications and the Website may contain links to third-party websites, applications or app-store listings. If you follow one, the relevant app store or third party may collect information about you, including that you arrived through our link, under its own privacy policy. We are not responsible for their practices. Please read their privacy policies.

Retention

We keep personal data only for as long as needed for the purposes above. In particular:

  • account data is kept while your account is active and deleted within 30 days after you delete it;
  • correspondence is kept for as long as needed to deal with your request and any follow-up, and to establish, exercise or defend legal claims;
  • technical and usage information, including Website logs, is kept for as long as needed to operate, secure and improve the Applications and the Website, after which it is deleted or anonymised; and
  • records we must keep by law (for example, for tax or accounting purposes) are kept for the period the law requires.

Account deletion

If an Application allows you to create an account, you can delete it at any time:

  • In the app. Open the Application’s settings, go to Account and choose Delete account.
  • From the web. Go to nigmatic.pro/account-deletion and follow the instructions to request deletion without reinstalling the Application.

The account-deletion page above is the external deletion resource listed with our Applications on Google Play and, where applicable, the App Store.

Security

We use reasonable technical and organisational measures to protect personal data. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

International transfers

Where we transfer personal data outside the European Economic Area, we do so only to countries covered by an adequacy decision of the European Commission or under appropriate safeguards, such as the European Commission’s standard contractual clauses. You can ask us for details at info@nigmatic.pro.

Your rights

Under the GDPR, you have the right to request access to your personal data, and its rectification or erasure, to request restriction of processing, and, where processing is based on consent or contract and carried out by automated means, to receive your data in a portable format. Where we rely on your consent, you may withdraw it at any time, as easily as you gave it; withdrawal does not affect processing carried out before it.

Right to object. Where we process your personal data on the basis of our legitimate interests, you have the right to object at any time, on grounds relating to your particular situation. We will then stop the processing unless we demonstrate compelling legitimate grounds that override your interests, rights and freedoms, or the processing is needed for legal claims. Where we process your personal data for direct marketing, you may object at any time and we will then stop processing it for that purpose.

To exercise any of these rights, email info@nigmatic.pro or turn off the relevant permission in your device settings. We will respond without undue delay and in any event within one month, which may be extended by two further months where necessary; in that case we will tell you why within the first month. We may ask for information to confirm your identity.

You also have the right to lodge a complaint with a supervisory authority. In Cyprus this is the Commissioner for Personal Data Protection (www.dataprotection.gov.cy).

Age

The Applications and the Website are intended for persons aged 18 and over. We do not knowingly collect personal data from anyone under 18. If you believe a minor has provided us with personal data, contact info@nigmatic.pro and we will delete it.

Changes to this policy

We may update this policy. We will post the new version on the Website with its date and, where changes are material, give notice in the Applications or on the Website.
